Copyright Statement
The Wyoming State Historical Society contributed several items to the Western Trails Project and has addressed the issue of copyright as discussed below.
Ryan Bench has granted the Wyoming State Historical Society the opportunity to display six of his landscape paintings for use on the digitization project per an agreement from 2003.
The Wyoming State Historical Society is the owner of both the Paulley paintings and their copyright per an agreement in 1986.
The L.C. Bishop Maps are copyrighted by the Wyoming State Archives and have records as such on all of the maps. For example, the Fort Laramie and Fort Fetterman maps say "© -Wyoming State Archives & Historical Department 1959."
As to the Annals of Wyoming, the State of Wyoming held the copyright of record until 1953. From then until 1995, the copyright was held by the State of Wyoming and the Wyoming State Historical Society. Since 1995, the Annals publisher tells all authors that the Wyoming State Historical Society receives only "first North American serial rights" for articles accepted for publication. All rights beyond the initial publication remain with the authors.
However, on June 2, 2003, the Supreme Court voted 8-0 that the law does not allow creators to claim plagiarism when their uncopyrighted works are used. So, the Wyoming State Historical Society will follow the assumption regarding articles written after 1995 that once something goes into the public domain, such as being originally published in the Annals, that it cannot be taken back into the private domain.
